The Owner will confirm the reservation as soon as possible after receipt of the signed rental agreement and $250.00 deposit is received. The remaining balance must be paid 4 weeks prior to arrival.
Rental Terms and Conditions
The following Terms and Conditions in the rental agreement are essential to ensure the quality of your stay and that of future guests.
The Tenant, the undersigned, agrees to rent ______________________(the “Property”) for vacation or recreation purposes, and agrees as follows:
1. The Tenant is 21 years of age or older (proof of age may be requested).
2. The Tenant shall be permitted to rent the Property for the occupancy dates set forth in Page 1 of this Agreement, and in consideration thereof, the Tenant agrees to pay the rental fee set forth in Page 1 of this Agreement in the payment method provided above.
3. The Tenant understands that the reservation of the Property is not finally confirmed until this Rental Agreement has been returned and the Deposit, as set forth in Page 1, cleared. Failure to make payments when due may result in cancellation of this Agreement.
4. Tenant understands that the Property shall be in clean and tidy condition upon arrival and set up with furnishings, linens, dishes, cooking utensils and other household necessities for an enjoyable occupancy. Tenant understands that he/she has the right to inspect the Property prior to signing this Agreement but has waived that right and agrees to accept the rental property upon arrival, provided it meets the basic description as listed on the Rental Websites. In addition, Tenant agrees that he/she will not be entitled to a refund of rent money, nor relocation to another property, and will have no claim or recourse against the Owner.
5. The Tenant agrees that the home and all contents of home will be in the same condition at the end of occupancy as at the beginning of occupancy. A damage/reservation deposit of $250 must be received within seven (7) days of booking the reservation. The deposit automatically converts to a security/damage deposit upon arrival. The deposit is NOT applied toward rent; however, it is fully refundable within (14) days of departure, provided the following provisions are met. a. No damage is done to unit or its contents, beyond normal wear and tear. b. No charges are incurred due to contraband, pets or collection of rents or services rendered during the stay. c. All debris, rubbish and discards are placed in the trashcan, and soiled dishes are placed in the dishwasher and cleaned. d. All keys are returned to the lock box and villa is left locked. e. All charges accrued during the stay are paid prior to departure. f. No linens are lost or damaged. g. No Early check-in or late check-out. i. The renter is not evicted by the owner (or representative of the owner), the local law enforcement, or the security company employed by My Complex. j. The villa has not been smoked in.
6. The Tenant agrees not to smoke in the house or use illegal substances on or around the property and also agrees to ensure that the guests and visitors of the Tenant comply. If evidence to the contrary is discovered; the tenant will be responsible for the cost of odor removal. Illegal substances are strictly prohibited and grounds for immediate eviction.
7. Tenant agrees that no pets are allowed. Guests who bring pets without prior approval will forfeit their security deposit and may be evicted from the property.
8. Tenant understands that house parties are strictly prohibited without prior written approval of Landlord and grounds for immediate eviction.
9. Tenant agrees to permit Owner or Owner’s Agent to enter the premises in the event of an emergency in order to perform necessary repairs and/or maintenance.
10. We accept MasterCard, Visa, Direct Deposit, and Personal Checks on a case by case basis payable to Kensington Villa. Checks are only accepted on advance bookings. An advance payment equal to 50% of the rental rate is required sixty (60) days before arrival. The advance payment will be applied toward the villa rent. The BALANCE OF RENT is due in full thirty (30) days before your arrival date. The reservation/damage deposit is NOT applied toward rent. For late bookings (within 30 days of arrival date) full payment is required at time of booking.
11. A sixty (60) day notice is required for cancellation. Cancellations that are made more than sixty (60) days prior to the arrival date will incur no penalty. Cancellations or changes that result in a shortened stay, that are made within 60 days of the arrival date, forfeit the full advance payment and damage/reservation deposit. Cancellation or early departure does not warrant any refund of rent or deposit.
12. Monthly renters must cancel one hundred twenty (120) days prior to check-in. Monthly renters who make a change that results in a shortened stay must be made at least ninety (90) days prior to check-in.
13. The maximum number of guests is limited to twelve (12) persons. An additional charge or $10.00 per person per night for guests in addition to twelve (12) will be assessed. THIS PROPERTY REQUIRES A THREE (3) NIGHT MINIMUM STAY.
14. Longer minimum stays may be required during holiday periods. If a rental is taken for less than three days, the guest will be charged the three-night rate.
15. Rates include a one-time linen-towel setup. Taxes and utility fees are included in the rental rate.
16. While linens and bath towels are included with the rental, daily maid service is not included in the rental rate. If you plan on going to the beach, we suggest you bring beach towels as we do not permit towels or linens to be taken from the villa.
17. Rates subject to change without notice.
18. Any reservation obtained under false pretense will be subject to forfeiture of advance payment, deposit and/or rental money, and the party will not be permitted to check-in.
19. Any exceptions to the above mentioned policies must be approved in writing in advance.
20. Parking is allowed in the driveway for the villa only. No vehicles are to be parked on the curbside.
21. HURRICANE OR STORM POLICY – No refunds will be given unless: a. The National Weather Service orders mandatory evacuations in a "Tropical Storm/Hurricane Warning area" and/or b. A "mandatory evacuation order has been given for the Tropical Storm/Hurricane Warning" area of residence of a vacationing guest. The day that the National Weather Service orders a mandatory evacuation order in a "Tropical Storm/Hurricane Warning," area, we will refund:
1. Any unused portion of rent from a guest currently registered, 2. Any unused portion of rent from a guest that is scheduled to arrive, and wants to shorten their stay, to come in after the Hurricane Warning is lifted; and 3. Any advance rents collected or deposited for a reservation that is scheduled to arrive during the "Hurricane Warning" period.
22. The septic system is very effective; however, it will clog up if improper material is flushed. DO NOT FLUSH anything other than toilet paper. No feminine products should be flushed at anytime. If it is found that feminine products have been flushed and clog the septic system. A minimum of fifty dollars will be charged for each visit to de-clog each toilet.
23. No offensive activity shall take place within the community, nor shall anything be done which may be or become an annoyance or nuisance to the neighborhood and no noise or disturbances which will interfere with the right, comfort or convenience of the neighbors.
24. All children must be supervised at all times. The Owner does not accept responsibility in the event of injury or death caused as a result of the use of the pool area. Please utilize the provided pool safety gate for you little ones.
25. The Tenant rents the Property as is and agrees not to sue over any condition at the Property and further agrees to indemnify and save and hold harmless Owner and Owner Agent from all liability, injury, claims, demands, losses, or damages incurred on the Property by anyone or incurred in the neighborhood as a result of any action or inaction by Tenant or by Tenant’s guests or invitees.
I agree that all rental monies are non-refundable per cancellation policy above.
